By using our website (verusheart.com) and services, you're agreeing to these Terms and Conditions. We've written them to be clear and straightforward, but if you have any questions, please reach out to us by email here.
2. What We Do
2.1 Our Mission
At Verus, we provide AI-powered surgical consultations, risk assessments, and surgeon-verified second opinions to help you make informed decisions about cardiac surgery. Our services are educational and consultative - they're designed to empower you with information as you work with your treating physicians.
2.2 Working Together with Your Healthcare Team
Our consultations don't replace your relationship with your doctor. Think of us as an additional resource providing educational insights and second opinions to help inform your discussions with your treating physician. Your doctor remains responsible for your medical care and treatment decisions.
2.3 Emergency Situations
Important: Our services aren't designed for medical emergencies. If you're experiencing a medical emergency, please call 911 or your local emergency services immediately.
3. Important Medical Information
3.1 Educational Resource
Everything we provide - reports, consultations, and assessments - is educational information to help you have more informed conversations with your healthcare team.
3.2 Individual Results May Vary
Every person is unique. We cannot guarantee specific medical outcomes or surgical results, as these depend on many individual factors.
3.3 Your Doctor Knows You Best
Your treating physician has the complete picture of your health and medical history. Our assessments provide additional perspective, but your doctor's recommendations, based on their direct knowledge of your case, should guide your medical decisions.
3.4 Based on U.S. Guidelines
Our recommendations follow U.S. medical guidelines and standards (ACC / AHA / STS). Medical practices may vary in different locations and institutions.
3.5 State Licensing
If you're in a state where our consulting physician isn't licensed, our services are educational only and don't constitute medical care. When our physician is licensed in your state and a telehealth encounter occurs, that encounter follows your state's telemedicine laws and our Telehealth Consent.
4. How Our Service Works
4.1 Our Commitment to Timely Service
We aim to provide initial consultation callbacks within 60 minutes and complete MyVerus™ Reports within 72 hours after we receive complete records and payment. While we work hard to meet these targets, exact timing may vary based on consultant availability and case complexity. These timeframes are targets only and don't create any obligation or liability.
4.2 What You'll Need
To use our services, you'll need:
- A compatible device with internet access
- Ability to upload or mail medical records
- A valid payment method
- You must be 18+ (or have parent/guardian consent for minors)
4.3 Service Updates
We continuously improve our services and may update features from time to time. We'll notify you of any significant changes.
5. Service Packages, Payment, and Refunds
5.1 Service Packages
Our current Verus service packages:
- Verus Core: Single physician chart review
- Verus Advanced: Chart and imaging review
- Verus Multi: Surgeon and cardiologist review
- Concierge Core: 24/7 MD access through surgery
- Concierge Plus: MD access through discharge
Your Verus consultant will provide you with a personalized package based on your individual case.
5.2 Payment Processing
All payments are processed through our third-party payment processors (Stripe). Your payment information is protected using industry-standard encryption. Verus doesn't bill insurance - you may submit receipts to your plan if permitted.
5.3 Refund Policy
- Before work begins (no intake started): Full refund within 7 days of purchase
- After intake begins but before clinician review: 50% refund
- After clinician review begins or Report delivered: Case-by-case basis
Refund requests must be submitted by email within 30 days of purchase.
5.4 Questions About Charges?
Payment disputes must be submitted in writing within 30 days of the charge date.
6. Privacy and Data Protection
6.1 HIPAA Compliance
We maintain appropriate safeguards for Protected Health Information (PHI) in accordance with HIPAA requirements. For PHI received from covered entities, we act as a Business Associate and will execute a Business Associate Agreement (BAA) upon request. For direct-to-consumer engagements, we apply HIPAA-level safeguards.
6.2 How We Use Your Information
We use PHI to:
- Provide services (intake, triage, review, Report generation)
- Ensure quality improvement
- Comply with legal requirements
We maintain minimum-necessary access, with subcontractors under BAAs as required. We don't sell PHI and don't use PHI for marketing without your written authorization.
6.3 Security Measures
- Encryption in transit and at rest
- Role-based access limited to authorized personnel
- Audit logs and multi-factor authentication for staff
- No PHI via standard email / SMS (secure portal only unless you request otherwise and accept the risk)
- Medical records maintained in HIPAA compliant storage
6.4 Document Verification
Your MyVerus™ Reports are secured with SHA256 hashing for tamper-proof verification.
6.5 Your Privacy Rights
You have the right to:
- Access: Receive copies of your PHI and designated record set
- Amend: Request corrections to your PHI
- Accounting: Get a list of certain disclosures
- Restrictions: Request limits on uses/disclosures (we'll honor when legally required)
- Confidential Communications: Request contact by alternate means
- Breach Notice: Receive notifications per HIPAA and state law

6.6 Data Retention
We retain consultation records and PHI as required by law (typically 7 years, longer if required).
7. Referral Compliance
7.1 Stark Law and Anti-Kickback Compliance
Verus maintains strict compliance with federal healthcare regulations.
We don't pay referral fees to physicians or entities in violation of Stark Law or the Federal Anti-Kickback Statute.
8. Your Responsibilities
8.1 Accurate Information Matters
To provide you with the best possible consultation, we need accurate and complete medical information. Please ensure all information you provide is current and correct.
8.2 Appropriate Use
We ask that you:
- Use our services lawfully and respectfully
- Keep your login credentials secure
- Provide truthful information
- Work with your treating physician when making medical decisions
- Respect our intellectual property and that of others
- Discuss our Reports with your treating clinicians before making medical decisions
9. Intellectual Property
9.1 Our Content
Our website content, brand materials, the Verus name and logo, and our proprietary AI consultation process are protected by intellectual property laws. We use various third-party software platforms to deliver our services, which remain the property of their respective owners.
9.2 Your Reports Belong to You
Your MyVerus™ Reports are yours. You can share them with your healthcare providers, family members, or anyone else you choose.
9.3 Control Over Your Information
You can manage who has access to your reports through your Verus Portal at any time. You may grant or revoke permission to share your reports. Revocation applies to future sharing only and doesn't affect reports already shared.
10. Communications
10.1 How We Communicate
By using our services, you consent to receive electronic communications from us, including:
- Administrative emails and portal messages
- SMS messages (optional, message / data rates may apply)
- Appointment reminders and service updates
10.2 Our Response Time Goals
We target a 60-minute callback for initial consultations. While we do our best to meet this goal, response times may vary based on consultant availability and technical capabilities.
11. Limitations and Protections
11.1 Reasonable Limits
While we strive for excellence, if something goes wrong, our total liability is limited to the amount you paid for the specific service in question.
11.2 What We Cannot Be Responsible For
We cannot be held responsible for:
- Medical outcomes or complications
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, or data
- Technical issues beyond our control
- Decisions you make based on our educational information
- Differences of opinion between our consultants and your physicians
- Delays in service delivery
11.3 Shared Responsibility
You agree to defend, indemnify, and hold us harmless from claims arising from:
- Your use or misuse of our services
- Violation of these terms
- Violation of any rights of another party
- Your medical decisions or outcomes
- Inaccurate information you provide
12. Service Availability
12.1 As-Is Service
We provide our services "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
12.2 Professional Opinions
Our consultants provide their professional medical opinions based on the information available. Different consultants may have varying viewpoints, which is part of the value of a second opinion. Reasonable clinical disagreement may occur.
13. Resolving Disputes
13.1 Applicable Law
These terms are governed by Nevada law.
13.2 Arbitration
If we have a dispute we can't resolve through discussion, we agree to use binding arbitration through the American Arbitration Association rather than going to court. This is typically faster and less expensive for everyone.
13.3 Individual Resolution
Any disputes will be handled individually, not as part of a class action.
13.4 30-Day Opt-Out
You may opt out of arbitration by emailing us here within 30 days of first accepting these terms.
14. Additional State Provisions
14.1 California Residents
California residents have additional rights under the California Consumer Privacy Act (CCPA). See our Privacy Policy for details.
14.2 International Users
Our services are operated from the United States. Information will be transferred to and processed in the U.S.
15. General Provisions
15.1 Updates to These Terms
We may update these terms occasionally. If we make significant changes, we'll notify you by email or through our services. Continuing to use our services after changes means you accept the updated terms.
15.2 Severability
If any part of these terms is found to be unenforceable, the rest remains valid.
15.3 Entire Agreement
These terms, along with our Privacy Policy and HIPAA Notice, represent our complete agreement.
15.4 Minors
Parent / guardian consent is required for anyone under 18. We may require identity verification and documentation.

Verus Expert Review - Chart Review Service
Scope of Service
- Single physician review of provided medical records
- Written assessment included in MyVerus™ Report
- Educational interpretation of clinical data
- STS risk assessment based on available information
- Guideline mapping to ACC / AHA / STS standards
Limitations
- Review limited to documents provided; incomplete records may affect assessment accuracy
- No imaging interpretation included
- Consultant cannot identify issues not evident in provided documentation
- Assessment based solely on written records without a medical examination
- No ongoing support after report delivery
Your Acknowledgments
- You understand this is a records-based review only
- You accept that missing or incomplete records may limit the consultation's value
- You will provide all relevant medical records available to you
- You understand the consultant has not examined you physically
- Any findings or missed findings in your records remain the responsibility of your treating physicians
Verus AIR (Advanced Image Review) - Chart + Imaging Review Service
Scope of Service
All Expert Review services plus:
- Review of imaging studies (CT, MRI, angiography, echocardiography)
- Educational interpretation of imaging findings
- Correlation between imaging and clinical data
- Identification of potential additional findings
Important Imaging Disclaimers
- Our review is educational and supplementary to official radiology reports
- We may identify findings not mentioned in original reports OR may not identify all findings
- This is NOT a replacement for formal radiology interpretation
- Technical quality of images may limit review completeness
- We cannot be held liable for findings identified or not identified
Your Acknowledgments
- You understand our imaging review is educational, not diagnostic
- You accept that image quality and completeness affects review accuracy
- You will discuss any identified findings with your treating physician
- You understand we may not identify all abnormalities
- Timing differences between imaging and current condition may exist
- You will not rely solely on our imaging interpretation for medical decisions
Verus Connect - Concierge Service
Scope of Service
All selected package services plus:
- 24/7 access to Verus physician through surgery via phone, text, and Verus Portal
- Pre-surgical guidance and education
- Emotional support and question answering
- Coordination assistance (educational only)
- Service continues through day of surgery
Critical Limitations - 24/7 Access
Response Times: While we strive for immediate response:
- Phone calls will be answered when possible and returned as soon as practicable if missed.
- Text / Verus Portal messages will typically answered within 2-4 hours
- Overnight responses may be delayed
- Technical issues may prevent immediate contact
- Physician illness / emergency may affect availability
We CANNOT and WILL NOT:
- Prescribe medications or adjust current medications
- Override your surgeon's instructions
- Provide treatment for medical emergencies (call 911)
- Communicate directly with your surgical team on your behalf
- Provide medical clearance for surgery
- Treat conditions unrelated to your cardiac surgery
- Make changes to your surgical plan
Boundaries of Support
- Support is educational and emotional, not treatment
- One account covers one user only (not family members)
- Service terminates on day of surgery
- Abuse of service may result in termination without refund
Your Acknowledgments
- 24/7 availability is a target, not a guarantee
- Response times may vary
- You will call 911 for any emergency
- You will follow your surgeon's instructions even if they conflict with our educational information
- You understand we cannot prescribe or adjust medications
- You accept we cannot provide treatment
- Service is for Verus service subscribers only
Verus Care - Concierge Service
Scope of Service
All Connect Concierge services plus:
- Post-operative education and guidance
- Recovery milestone education
- Discharge planning assistance (educational)
- Service continues through recovery until hospital discharge
Additional Post-Operative Limitations
We CANNOT:
- Interpret post-operative tests or labs
- Assess surgical sites or wounds
- Determine if symptoms are normal or concerning
- Replace post-operative care team
- Make decisions about readiness for discharge
- Prescribe pain medications or antibiotics
- Determine if complications are occurring
Critical Post-Operative Disclaimers
- Post-operative complications require immediate attention from your surgical team
- We cannot assess physical symptoms or wounds
- Any concerning symptoms should be reported to your surgical team or 911
- Our role remains educational during your recovery
- Hospital care team decisions supersede our educational information
Your Acknowledgments
- You will report all concerning symptoms to your hospital care team
- You understand we cannot assess post-operative complications
- You accept that hospital care team has primary responsibility
- You will not delay seeking medical attention based on our input
- Service terminates upon hospital discharge
- Re-admissions are not covered under original service
Verus Circle - Concierge Service
Scope of Service
All Care Concierge services plus:
- Service continues for 30 days post hospital discharge
Additional Post-Operative Limitations
We CANNOT:
- Interpret post-operative tests or labs
- Assess surgical sites or wounds
- Determine if symptoms are normal or concerning
- Replace post-operative care team
- Make decisions about readiness for discharge
- Prescribe pain medications or antibiotics
- Determine if complications are occurring

- We cannot assess physical symptoms or wounds

- Meets Class I guideline indication for Heart Team review in certain conditions
Heart Team Considerations
- Different specialists may have differing opinions
- Recommendations may conflict with your current treatment plan
- Final synthesis represents educational consensus, not binding medical advice
- Local factors at your institution may affect feasibility of recommendations
Your Acknowledgments
- You understand multiple opinions may vary
- You accept that consensus recommendations are educational
- You will discuss all options with your treating team
- Local expertise and resources may differ from our recommendations
- Insurance coverage for recommended treatments may vary
- Geographic and institutional capabilities affect treatment availability
Universal Service Limitations

- We cannot guarantee our review will identify all issues
- We cannot guarantee our recommendations will improve outcomes
- Different consultants may reach different conclusions
- Medical standards and guidelines evolve continuously
Geographic and Institutional Variables
- Surgical expertise varies by location
- Hospital capabilities differ

- Regional practice patterns differ
- Availability of recommended treatments varies
Technology and Communication
- Technical failures may prevent service delivery
- Your internet connectivity issues are your responsibility
- Phone / text services depend on carrier availability
- Time zone differences may affect communication
- Electronic communications may be delayed or fail
Relationship Boundaries
- No doctor-patient relationship exists
- We cannot replace your treating physicians
- Our opinions are educational only
- We have no hospital privileges at your facility
- We cannot admit, discharge, or treat you
- We cannot appear at medical proceedings
Financial Limitations
- No guarantee of insurance coverage for recommended treatments
- No responsibility for costs of recommended treatments
- No liability for financial consequences of following educational recommendations
- Refunds subject to refund policy regardless of outcome
By purchasing any service package, you expressly acknowledge and accept all applicable limitations and agree to hold Verus Surgical Consultants harmless from any consequences arising from these inherent limitations of educational consultation services.
